Under Section 167, healthcare facilities in New York are prohibited from requiring nurses to work beyond their regularly scheduled shifts (whether that schedule is 8, 10, or 12 hours).
Legal Exceptions to the Prohibition
Hospitals can only enforce mandatory overtime under specific, legally defined emergency circumstances:
- Health care disaster emergencies declared by state or local governments.
- Natural disasters or severe environmental emergencies.
- Unforeseen emergency events endangering patient safety (must document efforts to seek voluntary coverage first).
Safe Staffing Enforcement & Pay Rights
New York's Safe Staffing rules require clinical staffing committees to set enforceable nurse-to-patient ratios in general hospitals and nursing homes. When nurses work voluntary overtime to cover gaps, standard FLSA and New York state overtime rates (1.5x regular pay plus shift differentials) apply immediately after 40 hours in a workweek.
